Murray Fogler and Robin O’Neil win appeal for client, Hogan Lovells US LLP.

Murray Fogler and Robin O’Neil represent Hogan Lovells US LLP in a breach of fiduciary duty suit brought by Chicago Bridge & Iron Company, a former client of a Hogan Lovells lawyer. Hogan Lovells sought to stay the claims in favor of arbitration based on a provision in the contract governing the underlying dispute. The trial court granted the stay, preventing CB&I from proceeding with its claims against the firm. On Thursday, April 23, 2015, the Ninth Court of Appeals declined to grant the former client’s petition for mandamus relief, leaving the stay intact.
