Murray Fogler recently obtained a significant judgment for the client, Strasburger & Price, L.L.P.  Fogler represents Strasburger who had been sued in a shareholder-derivative suit. Plaintiffs in the suit sued Strasburger for malpractice, alleging that Plaintiffs’ directors and business partners—whom Strasburger represented in the underlying transactions at issue—sabotaged Plaintiffs’ start-up business, a multi-branch surgical-education school.

On Friday April 17, 2015, Houston trial judge Alexandra Smoots-Hogan, presiding judge of the 164th District Court for Harris County, entered an order granting Defendant Strasburger & Price’s plea to the jurisdiction. In the order, the trial court dismissed all claims against Strasburger with prejudice, agreeing with Strasburger that the shareholder-derivative plaintiffs lacked standing to sue Strasburger.
