Jas Brar

Jas Brar represents all types of clients, from Fortune 100 companies to individuals, in all types of commercial disputes. He has particular experience representing clients in the oil and gas, health care, real estate, legal, and financial industries, to name a few.  He has repeatedly been recognized as a Texas Super Lawyer in business litigation.  Clients have praised his skill in the courtroom and entrust Jas to represent them in their most challenging and high-stakes disputes.

Representative Matters

COMMERCIAL LITIGATION

  • As lead trial counsel, obtained jury verdict in favor of an individual client in a breach of contract dispute with an automobile franchise. After deliberating for less than one hour, the jury awarded full damages on his client’s breach of contract claim and attorney’s fees.
  • Obtained jury verdict in a partnership dispute involving a textile business, where a former employee claimed to be a partner in the business, seeking a one-half share of the business, and damages in excess of $10 million. After a three-week trial, the jury returned a verdict in favor of his client, rejecting all of the plaintiff’s claims. The jury also found in favor of his client on its counterclaims against the plaintiff. Jas tried the case with Murray Fogler.
  • Part of the trial team that obtained jury verdict on behalf of Hewlett Packard in a lawsuit seeking damages for a breach of contract claim against an electrical service provider.
  • Obtained summary judgment on behalf of valve manufacturer and its high-level executives in case involving antitrust allegations. Jas drafted the motion to dismiss, convincing the trial court that the claims were barred by a prior release entered into by the parties. The trial court also awarded attorney’s fees on his client’s counterclaim for breach of the release.

ENERGY

  • Represented a Fortune 100 midstream energy company in a breach of contract dispute concerning a capacity lease on a pipeline. The case settled on favorable terms after the defendant’s motion to transfer venue was denied.
  • Defended an oil and gas exploration and production company in a dispute in which the plaintiff alleged breach of a joint operating agreement and fraud relating to joint operating expenses, among other claims.
  • Represented an oil and gas exploration and production company in a dispute concerning the unlawful drainage of a common reservoir in the Outer Continental Shelf.
  • Defended a large manufacturer of valves, pumps, and actuators in a breach of contract and warranty dispute concerning the alleged failure of valve actuators.
  • Represented a Fortune 100 midstream company in an arbitration proceeding concerning termination rights of various agreements involving a natural gas pipeline and gas processing plant.

PROFESSIONAL LIABILITY

  • Defended Am Law 100 law firm in case involving allegations of malpractice in connection with patent prosecution. Following a three-week jury trial, the trial court entered a take nothing judgment in favor of our client. Jas tried the case with Murray Fogler and Michelle Gray. The case is currently on appeal.
  • Defended large Texas-based law firm in a case involving allegations of malpractice in connection with investments in several oil and gas properties.
  • Represented prominent plaintiff’s lawyer in connection with allegations that he committed malpractice arising out of a land dispute in Galveston County. Following the filing of the motion to dismiss argued and drafted by Jas, the case was dismissed with prejudice.
  • Successfully defended prominent plaintiff’s lawyer in a trial where he was accused of improperly deducted expenses from a large, mass-tort settlement. After a two-week trial, the jury returned a verdict dismissing all of the plaintiffs’ claims.

REAL ESTATE

  • Defended one of the nation’s largest real estate brokerage firms in an arbitration proceeding involving breach of fiduciary duty, fraud, and negligent misrepresentation claims. After a three-day hearing, the Arbitrator found no liability and awarded a take-nothing judgment dismissing all claims.
  • Obtained summary judgment on behalf of a New York-based mortgage securities company in an arbitration where a large group of plaintiffs brought fraud, deceptive trade practices, and negligence claims arising out of real estate purchases. Plaintiffs were seeking in excess of $100 million dollars. The arbitrator dismissed all claims against his client with prejudice.
  • Represented two high-level executives of a Real Estate Investment Trust in a lawsuit against the former CEO. The lawsuit involved claims of breach of fiduciary duties, fraud, negligent misrepresentations, breach of contract, and unjust enrichment. The case settled during trial.
  • Represented a publicly-traded Real Estate Investment Trust in a dispute against a former employee concerning breach of contract and breach of fiduciary claims.

AVIATION

  • Secured take nothing summary judgment on behalf of large airline company in a case where the plaintiff was alleging the airline breached its contract of carriage. On appeal, the judgment was affirmed in all respects. Jas was lead counsel in the trial court and appellate proceedings.
  • Successfully defended a major airline company in class action dispute where the putative class was seeking tens of millions of dollars in alleged damages for fuel surcharges. Following the filing of the motion to dismiss drafted by Jas, the plaintiffs dropped their claims.

INTELLECTUAL PROPERTY/TRADE SECRETS

  • Defended high-level executives of a valve manufacturing company against allegations that they violated non-compete and confidentiality agreements in connection with starting their company.
  • Represented an international chemicals company in a trade secrets dispute involving a method for manufacturing polyethylene.
  • Defended a Canadian telecommunications and wireless equipment company in a patent infringement dispute concerning sixteen patents related to smart phones.

SECURITIES

  • Secured take nothing summary judgment on behalf of large financial institution in dispute where the plaintiff was seeking damages in excess of $20 million for alleged wrongdoing involving the sale of auction rate securities.
